Effective January 1, 2019, the Equal Employment Opportunity Commission (EEOC) removed the incentive limits from its final wellness plan rules that had been in place since 2017. The EEOC has indicated that it will publish new proposed regulations – possibly with new incentive limits – on employer-sponsored voluntary wellness programs in 2019. In the meantime, employers should continue to ensure their wellness programs meet other regulatory guidelines.
