There is a tremendous amount of confusion around what it means for an employer’s plan to be “affordable” under the ACA. It’s not surprising because there are two different kinds of affordable criteria. First there is the definition of when an employer’s plan is affordable for purposes of an individual who is purchasing individual health insurance and trying to qualify for a subsidy. Separately, there are the three employer affordability safe harbors provided by the IRS to help employers set contribution rates in a manner that mitigates their §4980H(b) penalty risk.
